The Art & Science Of HEOA Compliance

If you are one of the more than 6000 colleges or universities that receive Federal funding, the Higher Education Opportunity Act (HEOA) applies to you.
Passed by Congress on August 14, 2008, one of the policies of the Act requires that colleges and universities reduce student use of campus networks to illegally upload and download copyrighted materials using peer-to-peer (P2P) networks. (www.ed.gov/HEOA).
Effective, Measurable and Affordable Compliance
According to the HEOA, effective technology solutions must:
- Reduce unauthorized P2P traffic on your network.
- Include an education component that communicates the proper use of the Internet in respect to the rights of copyright and other intellectual property owners.
- Notify students of your institution's judicial procedures regarding unauthorized downloads of copyrighted material.
- Provide a periodic review with measurable criteria that shows the effectiveness of the solution.
Just What Exactly Must Be Done?
All Federally funded institutions of higher learning must:
- Annually inform students that illegal distribution of copyrighted materials may subject them to institutional, civil and criminal penalties.
- Certify to the Secretary of Education that they have developed and implemented plans to "effectively combat" the use of their networks for illegal uploads and downloads of copyrighted material.
- Encourage the use of legal alternatives.
- Implement the use of technology-based deterrents that detect and prevent the unauthorized distribution of copyrighted works over P2P networks.
